The Supreme Court did not establish a "legal status" requirement for parents. The Real Requirements Established in 1898: The Court ruled that the only requirements for birthright citizenship under the 14th Amendment are:
1) Birth on U.S. soil (territorial presence). 2) Being "subject to the jurisdiction" of the U.S., which the Court interpreted to mean anyone present in the country who must follow its laws.
